As the fiscal sponsor of Stronger Foundations for Nutrition, The Eleanor Crook Foundation (“Foundation,” “we,” “our,” or “us”) owns and/or operates this website (together with any other websites owned and/or operated by the Foundation, the “Sites”). The Sites are provided by the Foundation to the person accessing the Sites (“you” or “your”).

The Foundation has created this privacy policy to explain what information we gather from you when you visit our Sites or otherwise interact with us, how we may use this information, to whom and under what circumstances we may disclose it, and the security approaches we use to protect your information (this “Privacy Policy”). As used in this Privacy Policy, “Personal Information” includes anything that identifies, relates to, describes, is capable of being associated with, or could be reasonably linked, directly or indirectly, with a particular individual or household. Your access to, and use of, the Sites is also subject to the Foundation’s Website Terms of Use, available at uniform resource locator (as such terms of use may be modified from time to time as described therein, the “Terms of Use”).

This Privacy Policy is incorporated and made part of the Foundation’s Terms of Use.

By using the Sites, you consent to the collection, use, processing, transfer, and disclosure of your information by the Foundation in accordance with this Privacy Policy. If you do not agree to the Privacy Policy, please do not visit or use the Sites. We may modify this Privacy Policy at any time and will post the current version on the Sites. We encourage you to periodically review our Privacy Policy to stay informed about how we are using the information we collect.

• The public when we communicate activities, achievements, and updates regarding the Foundation’s assistance recipients or for other purposes consistent with the mission of the Foundation.

Browsing information:

• Internet Protocol (IP) address, MAC address, browser type, operating system, device-identifying information, the specific web pages visited during your connection, and the domain name from which you accessed the Sites.

• Information about your browsing behavior, such as the date and time you visit the Sites, the areas or pages of the Sites that you visit, the amount of time you spend viewing the Sites, the number of times you return to the Sites, and other clickstream data.

• When you visit the Sites; through the use of cookies and other tracking technologies explained below in “Use of ‘Cookies’ or Similar Tools.”

• To personalize your experience with the Sites and to allow us to deliver the type of content and offerings in which you are most interested.

Combined Information: We may combine the information we collect from you with information we receive about you from other sources. 

Aggregate Information and De-identified Information:  We may aggregate the personal information that we collect identified above for purposes of statistical analysis, research, and other purposes.  In addition, non-Personal Information or de-identified information that we collect from you may be provided to other parties for marketing, advertising, or other uses.

Right to Opt-Out or Withdraw Consent: In some jurisdictions, individuals may have the right to opt-in or withdraw consent for certain uses. If you reside in such jurisdictions, you may have additional rights which are detailed in the “Access, Correction and Deletion of Personal Information” section below.If you do not wish to receive communications from us notifying you of Foundation activities, opportunities, and/or programs, you can opt-out of receiving these communications by following the instructions contained in the messages you receive. Even if you opt-out of receiving these messages, we reserve the right to send you certain communications relating to the services we provide, and we may send you service announcements and administrative messages. We do not offer you the opportunity to opt-out of receiving those communications.

Disclosure with Other Third Parties: Except to the extent expressly stated in this Privacy Policy, we generally do not sell, trade, or otherwise transfer to outside parties your Personal Information identified above, unless we provide you with advance notice or you direct us to share your Personal Information. The term “outside parties” does not include our affiliates, website hosting or payment processing partners, third-party vendors, and other parties who assist us in operating the Sites, conducting our operations, or servicing you, so long as those parties agree to keep this information confidential.

2. Use of “Cookies” or Similar Tools

Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. We use cookies to help us remember and process the items in your applications and programs. Cookies are also used to help us understand your preferences based on previous or current activity on the Sites, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about traffic on the Sites and interaction with the Sites so that we can offer better experiences with the Sites and our offerings in the future.

We may contract with third-party service providers (such as Google Analytics) to assist us in better understanding our visitors to the Sites. To learn how Google

Because there is not yet a common understanding of how to interpret web browser-based “Do Not Track” (“DNT”) signals other than cookies, we do not currently respond to undefined “DNT” signals to the Sites.

We acknowledge that our website is accessible to users from GDPR countries, and we are committed to complying with the General Data Protection Regulation.

We respect your privacy rights and strive to protect your personal data. By using our website, you consent to the collection, processing, and storage of your  personal information in accordance with this privacy policy. We will only use your personal data for the purposes specified in this policy and will not share it with third parties unless required by law or with your explicit consent. You have the right to access, rectify, delete, and restrict the processing of your personal data.

3. Access, Correction and Deletion of Personal Information

We respect your right to access and correct your Personal Information. You may contact us as indicated in the “Contact Us” section below to request that we correct or modify such information. You may also exercise your rights, subject to applicable laws, to request that we delete or restrict access to your personal data. We may need to retain it for legally permitted purposes, and this will be explained to you if necessary.

4. Retention of Personal Information

Personal Information that we collect, access, or process will be retained only as long as necessary for the fulfillment of the purposes for which it was collected, unless otherwise provided in agreements between you and the Foundation or as required or authorized by law. Personal Information that is no longer required to fulfill the identified purposes will be destroyed, erased, or made de-identified.

5. Safeguarding Your Personal Information

We maintain reasonable and appropriate measures designed to maintain information we collect in a secure manner. We have taken certain physical, electronic, and administrative steps to safeguard and secure the information we collect from visitors to the Sites. Even though we follow reasonable procedures to try to protect the information in our possession, no security system is perfect, and we cannot promise, and you should not expect, that your information will be secure in all circumstances. You agree to promptly notify us of any breach of security that you become aware of involving our Sites or services.

6. Privacy and Third-Party Links

This Privacy Policy applies solely to information collected through the Sites.  To provide you with increased value, we may include third-party links on the Sites, which may have privacy policies that differ from our own. We are not responsible for the activities and practices that take place on these websites. Accordingly, we recommend that you review the privacy policy posted on any external site before disclosing any Personal Information. Please contact those websites directly if you have any questions about their privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of the Sites and welcome any feedback about these linked sites (including if a specific link does not work).

7. Online Policy Only

This Privacy Policy applies only to information collected through the Sites and not to information collected offline.

8. Changes to This Privacy Policy

We may change this Privacy Policy from time to time, including as required to keep current with rules and regulations, new technologies, and security standards. When we do, we will post the change(s) on our Sites. If we change the policy in a material and retroactive manner, we will provide appropriate notice to you.

9. Children’s Privacy

We do not knowingly intend to collect Personal Information from children under 13 years of age. If a child has provided us with Personal Information, a parent or guardian of that child may contact us in writing at the address indicated in the “Contact Us” section below. Your letter must clearly state that it is a “Request for Child Information Removal” and the name and age of the child must be contained in the body of the message. We will then make reasonable efforts to delete the child’s information from the database that stores information for the Sites.

Further, if you are under 18 years of age and access or use the Site, you have the right to request removal of unwanted information that you publicly post on the Sites. To request removal of such information, please contact us in writing at the address indicated in the “Contact Us” section below.  Your letter must clearly state that it is for “Removal of Minor Information”. Upon receiving such a request, we will make sure that the information is not publicly available on the Sites, but the information may not be completely or comprehensively removed from our systems and databases.

10. Your California Privacy Rights

Under California law, you have a right to request certain information about our disclosure of Personal Information to third parties for their own direct marketing purposes during the preceding calendar year. Typically, this request is free and may be made once a year. To make such a request, please contact us in writing at the address indicated in the “Contact Us” section below. Your letter must clearly state that it is a “Request for Privacy Information Disclosure”.

Please note that the California Consumer Privacy Act does not apply to the Foundation as a non-profit. However, we are happy to address questions about the way we collect and use Personal Information as we are able, and please feel free to contact us with your questions as described below under “Contact Us.”

11. Visitors from Outside the United States—Cross-Border Transfer

The Sites are hosted in the United States. If you are visiting the Sites from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries in accordance with this Privacy Policy. The data protection and other applicable laws of the United States or other countries may not be as comprehensive as those laws or regulations in your country or may otherwise differ from the data protection or consumer protection laws in your country. Your information may be available to government authorities under lawful orders and law applicable in such jurisdictions. By using the Sites and/or providing Personal Information to us, you consent to the transfer of your information to our facilities as described in this Privacy Policy.

We are transparent about the ways in which we collect and use Personal Information and welcome your questions and concerns. To the extent you believe we have not addressed your concerns, or if you otherwise choose to do so for any reason, you have the right to lodge a complaint with a supervisory authority in the country where you reside and/or the United States. 1. You Agree to These Terms by Using the Sites

Your access to, and use of, the Sites is subject to the following terms of use (these “Terms of Use“) and all applicable laws and regulations.  By accessing and using any of the Sites, you indicate that you understand and intend the Terms of Use to be the legal equivalent of a signed, written contract and equally binding, and you accept, without limitation or qualification, these Terms of Use. These Terms of Use supersede all prior agreements or arrangements.  The Foundation may, at any time and without notice, modify these Terms of Use by revising them on the Sites.  Your continued use of the Sites constitutes your acceptance of any such revisions. You should therefore periodically visit this page to review the current Terms of Use.  You may not modify these Terms of Use except in a writing signed by the Foundation.

If you do not agree and accept, without limitation or qualification, these Terms of Use, you must exit the Sites immediately. We may immediately terminate these Terms of Use with respect to you (including your access to our services) if you fail to comply with any provision of these Terms of Use.

In addition, when utilizing the grant or other opportunities and/or services made available on behalf of the Foundation or its affiliates, you may be subject to additional restrictions, terms and conditions, guidelines, or rules applicable to such opportunities and/or services, which may be (a) posted from time to time on the applicable portions of the Sites, (b) otherwise made available to you in writing by the Foundation, or (c) otherwise mutually agreed in a written (including electronic) agreement (collectively, “Additional Terms“). The information and materials on the Sites are provided for personal, noncommercial, and general informational purposes. You may use the Sites solely for the purpose of learning about and/or utilizing the Foundation grant or other opportunities and/or services.  You may not use, reproduce, or distribute the text, graphics, downloads, tools, or any other content on the Sites for any other purpose.

Actual or attempted unauthorized use or access of the Sites (or any portion thereof, including any other account) may result in criminal and/or civil prosecution. For your protection, the Foundation reserves the right to view, monitor, and record activity on the Sites without notice or further permission from you. Any information obtained by monitoring, reviewing, or recording is subject to review by law enforcement organizations in connection with the investigation or prosecution of possible criminal activity on the Sites. The Foundation will also comply with all court orders involving requests for such information.

The Foundation reserves the right at any time and for any reason to deny you access to the Sites or any portion thereof, and to terminate this agreement. Termination will be effective without notice. The Foundation reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Sites and/or any information or services provided in connection with the Sites, with or without notice. You agree that the Foundation will not be liable to you or to any third party for any modification, suspension, or discontinuance of Sites or any grant or other opportunities and/or services.

3. User Submitted Content

The Sites may, from time to time, offer interactive features that allow users to submit content, communications, data, academic or other records, or other information or materials to the Sites (collectively, “User Content“).  The Foundation does not and cannot review all such User Content, and is not responsible for such User Content.

You acknowledge that by providing the ability to view and distribute User Content on the Sites, the Foundation is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability related thereto. However, the Foundation reserves the right to block or remove User Content that it determines to be unacceptable to the Foundation in its sole discretion.

Harassment in any manner or form on the Sites, including via email, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Foundation employee, host, or representative, as well as other members or visitors on the Sites, is prohibited. You may not upload to, distribute, or otherwise publish through the Sites any User Content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party, or which may otherwise give rise to liability or violate any law.

Any User Content received by the Foundation through the Sites will be deemed to include a royalty-free, perpetual, irrevocable, nonexclusive right and license for the Foundation to adopt, publish, reproduce, disseminate, transmit, distribute, copy, use, create derivative works of, display (in whole or part) worldwide, or act on such User Content without additional approval or consideration, in any form, media, or technology now known or later developed for the full term of any rights that may exist in such User Content. You expressly acknowledge and agree that you waive any claim to the contrary. The Foundation may, but will not be obligated to, use and/or provide any author attributions related to, any User Content. Any use of User Content by the Foundation will be subject to the Foundation’s Privacy Policy.

4. Authorization to Submit User Content

By submitting any User Content through the Sites, or otherwise making any User Content available to the Foundation, you hereby represent, warrant, and covenant that (a) you have full power and authority, and have obtained all necessary rights, approvals, authorizations and consents, to provide such User Content to the Foundation and permit the Foundation to use and disclose all User Content in accordance with the terms of these Terms of Use and the Foundation’s Privacy Policy; (b) such provision or making available of User Content to the Foundation is in compliance with all applicable laws, rules, and regulations; and (c) all such User Content is accurate and complete.

Without limiting the prior paragraph, you hereby acknowledge and agree that the Foundation and its third-party hosting partners, as applicable, may have access to User Content immediately upon your submitting such User Content through the Sites, regardless of whether any application, renewal, report, or other purpose for which such User Content is submitted has been completed and submitted and, as such, you shall be solely responsible for obtaining all parental and other consents and authorizations required in connection with the submission of such User Content in advance of uploading, submitting, or otherwise making available such User Content to the Foundation. 

5. Login and Passwords

In the event that, in connection with grant applications, renewals or reporting, or your other use of the Site, you receive a user ID, password and/or other login credentials to access certain portions and services of the Sites, you are responsible for maintaining the confidentiality of such user ID, password, login credentials, and account. You are also fully responsible for all activities that occur under your user ID, password, and account, if any. You agree to (a) not share or disclose your user ID, password, login credentials, account, or secure access procedure; (b) immediately notify the Foundation of any threatened or actual unauthorized use of your user ID, password, login credentials, or account or any other breach of security; and (c) log off at the end of each session. The Foundation shall not be liable for any loss or damage arising from your failure to comply with the provisions in this Section.

6. Notice; Electronic Communications

When you visit the Sites or send emails to the Foundation, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Sites. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

7. Privacy

The Foundation’s Privacy Policy, available at uniform resource locator (as such policy may be modified from time to time in accordance with its terms, the “Privacy Policy“), is hereby incorporated into and made part of these Terms of Use.  You hereby agree to such Privacy Policy.  Any Personal Information (as defined in the Privacy Policy), for example, your name, address, telephone number, or email address, that you transmit to the Sites by electronic mail or otherwise will be used by the Foundation in accordance with the Privacy Policy. Any other communication or material you transmit to the Sites, such as questions, comments, suggestions, or the like, will be treated as non-confidential and non-proprietary.

8. Typographical Errors

In the event that a Foundation grant or other opportunity and/or service, is mistakenly listed with incorrect specifications or instructions, the Foundation reserves the right to refuse or cancel any submissions to such grant or other opportunity and/or service, whether or not the submission has been completed.

9. Disclaimer – Warranty

THE SITES AND ALL CONTENT, MATERIALS, SERVICES, AND OPPORTUNITIES ON THE SITES ARE PROVIDED “AS IS.” TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, THE FOUNDATION HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

The Foundation does not represent or warrant that the functions contained in the Sites will be uninterrupted or error-free, that the defects will be corrected, or that the Sites or the server that makes the Sites available are free of viruses or other harmful components. The Foundation does not make any warranties or representations regarding the use of the materials in the Sites in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability, or otherwise. The Foundation does not make any warranties or representations regarding the security of your Personal Information. Some states do not permit certain limitations or exclusions on warranties, and as such, these limitations and exclusions do not purport to limit liability that cannot be excluded under the law in your usual place of residence.

10. No Guarantee

You hereby acknowledge and agree that the Foundation does not guarantee that applicants will receive any grant or other opportunity and/or service for which it makes a submission, or that any current recipient of a grant or other opportunity and/or service will continue to receive such benefits or services.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Foundation, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms of Use or our Privacy Policy or any negligent or wrongful conduct by you or any other person accessing the Sites using any account you register on the Site, including, without limitation, any User Content submitted by you or through any such account.

12. Limitations of Liability

YOUR USE OF THE SITES IS AT YOUR OWN RISK. NEITHER THE FOUNDATION, NOR ANY OF ITS SUBSIDIARIES, AFFILIATES, OFFICERS, OR DIRECTORS, NOR ANY OF ITS AGENTS OR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SITES OR THEIR CONTENT, ARE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR OTHER DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE SITES WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. Some states do not permit certain limitations or exclusions on warranties, and as such, these limitations and exclusions do not purport to limit liability that cannot be excluded under the law in your usual place of residence.

However, even if the third party is affiliated with the Foundation, the Foundation has no control over these linked sites, all of which may have separate privacy and data collection practices independent of the Foundation. The Foundation does not endorse the content, or any products or services available, on such sites. Nonetheless, the Foundation seeks to protect the integrity of its website and the links placed upon it, and therefore requests any feedback on not only its own Sites, but for sites it links to as well (including if a specific link does not work).

14. Retention of Rights; Limited License Grant

The Sites are owned by the Foundation and are protected by United States intellectual property laws (including trademark or copyright laws) and international treaty provisions. All content, including, but not limited to, text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, products, services, documentation, software, trademarks, service marks, trade names, logos, and icons provided by the Foundation or featured on the Sites are proprietary to the Foundation or its licensors.

The Foundation grants to you a personal, revocable, nonexclusive, nontransferable license to use the Sites conditioned on your continued compliance with the Terms of Use and Privacy Policy. Limited portions of the content on the Sites may be accessed, printed, and downloaded by you on an occasional basis for your own personal, non-commercial use. You may not under any circumstances copy, print, or download in any medium all or substantially all of the entire content of the Sites.
